Introduction

These Terms of Service ("Terms") govern your access to and use of Arc CAD ("we," "our," or "us"), a free, customizable CAD bot for community and staff management on Discord. By accessing or using Arc CAD, you agree to comply with these Terms.

If you do not agree to these Terms, please do not use Arc CAD.

Acceptance of Terms

By inviting and using Arc CAD, you agree to these Terms and any future amendments or updates. If you are using Arc CAD on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Information We Collect

We collect the following types of information when you use Arc CAD:

• Eligibility: You must be at least 13 years old to use Arc CAD. If you are under 13, you may not use the services of Arc CAD.
• License to Use: We grant you a non-exclusive, non-transferable license to use Arc CAD in accordance with these Terms. This license is for personal or organizational use and does not grant you any ownership rights over Arc CAD.
• Acceptable Use: You agree not to misuse Arc CAD or use it for unlawful purposes, including but not limited to:
• Violating Discord’s Terms of Service.
• Engaging in spamming, harassment, or other abusive behavior.
• Distributing malware, viruses, or other harmful software.
• Engaging in any activity that disrupts the performance or functionality of Arc CAD.

Account and Server Data

• User Data: Arc CAD may collect user data such as your Discord username, user ID, and server information to provide its services. We handle this data in accordance with our Privacy Policy.
• Server Access: When you invite Arc CAD to your server, you grant it access to the necessary server information required for functionality. You retain full control over the data and have the ability to disconnect the bot at any time.
• Data Ownership: You retain ownership of your server data and other inputs, but by using Arc CAD, you grant us a license to process and store this data as necessary for the functioning of the bot.
• To respond to support requests and address issues related to Arc CAD.

Bot Availability and Limitations

• Service Availability: Arc CAD is provided "as is" and may experience downtime due to server issues, maintenance, or other unforeseen circumstances. We do not guarantee that Arc CAD will be available at all times without interruption.
• No Warranty: We do not guarantee the accuracy, reliability, or suitability of Arc CAD for your needs. Use of the bot is at your own risk.

Termination of Service

• Your Right to Terminate: You can remove Arc CAD from your server at any time by issuing the appropriate command or following Discord’s bot removal procedure.
• Our Right to Terminate: We reserve the right to suspend or terminate your access to Arc CAD at our sole discretion, including if we determine that you have violated these Terms or engaged in harmful behavior.
• Consequences of Termination: Upon termination, your access to Arc CAD will be revoked, and all data associated with your use of the bot will be deleted or deactivated, as described in the Privacy Policy.

Changes to Terms

We reserve the right to modify or update these Terms at any time. When changes are made, the updated Terms will be posted with a new effective date. By continuing to use Arc CAD after the changes are posted, you accept and agree to the modified Terms.

Limitation of Liability

To the maximum extent permitted by law, Arc CAD and its creators, officers, and affiliates shall not be liable for any damages arising out of or related to your use of Arc CAD, including but not limited to direct, indirect, incidental, or consequential damages, loss of data, or business interruption.

Indemnification

You agree to indemnify and hold harmless Arc CAD, its developers, affiliates, and agents from any claims, losses, or damages arising from your use of the bot, including any violations of these Terms.

Dispute Resolution

In the event of a dispute, you agree to attempt to resolve the issue through informal means, such as contacting support. If a resolution is not reached, you agree to submit to binding arbitration.

Governing Law

These Terms are governed by the laws of [Your Country/State]. Any legal action or proceeding related to these Terms must be conducted in the courts of Chester COunty, Pennsylvania.
